I offer low-cost simple wills and powers of attorney, but I can also assist with complex estates involving such things as private corporations, trusts, and literary executorships. There are significant Canadian literary and music industry figures among my clients.

You can call me 'doctor' but I find that a bit pretentious.

If you die without a will, your property does not automatically go to the government. It will go to your closest living relatives, giving preference to your spouse and children, then parents, then siblings, then first cousins, following a rigid formula. It's probably not what you would choose if you thought about it and planned for it. Meanwhile, someone will have to apply to the court to be appointed to administer your estate. This is expensive and time-consuming. If you have dependents, they could end up in difficult circumstances. It is faster, easier, and cheaper for those you leave behind if there is a will, and you get to decide what happens. It's better all around.

Do you need a will?

The term “living will” is potentially misleading. It has nothing to do with your will, strictly speaking. Your will takes effect after you die. A living will refers to certain legal documents—specifically, powers of attorney—that enable you to put a plan in place should you be incapacitated by illness or serious injury but remain alive.A&nbsp;Continuing&nbsp;Power of Attorney for Property is the most important of these documents. Your attorney for property can access your bank accounts, manage your money, look after your property, and sell it if necessary in order to handle your affairs while you are not capable. If there is no document appointing someone to be your attorney for property, then your bank accounts and other assets might become inaccessible until you die—or until a court order is obtained allowing someone to act on your behalf. Obtaining a court order is expensive and can take a year or more. If you have dependents or significant assets, you should strongly consider having a Continuing Power of Attorney for Property in place.A Power of Attorney for Personal Care puts a person or group of people in charge of medical and personal-care decisions should you become incapacitated. Medical professionals are permitted to ask your spouse, children, parents, or siblings for direction if there is an urgent medical problem and you cannot speak for yourself. If you are close to your family, you may be comfortable with this arrangement, but doctors and pharmacists will not discuss private matters with your carer if they aren't named as an Attorney for Personal Care. Meanwhile, if you are estranged from your family, or if there is a parent, child, or sibling whose disposition toward you causes concern, a Power of Attorney for Personal Care ensures that only those you trust will be consulted. Your attorney for personal care need not be a family member; it can be anyone or any group of people you choose.These two types of powers of attorney enable you to put a living will in place so that, should disaster strike and you become incapacitated, people you trust are empowered to look after you, your dependents, and your property. It is much like insurance, and it's not costly.

What is a 'living will' and why should you have one?

Pets are family. Sometimes they're closer to us than our human family members, and it is reasonable to make plans for what happens to them if you die. You can appoint a carer in your will and provide them with funds to look after your best friend so that they can continue to live their best life if yours is cut short. It's a fairly common practice, and something you should consider. If you have a pet, you should really have a will.
